1. General Provisions

1. This privacy policy regulates the principles of collecting, processing and storing personal data. Personal data is collected, processed and stored by the data controller (Motorcity OÜ) (hereinafter the data processor).
2. The data subject in the meaning of the privacy policy is a customer or other natural person whose personal data is processed by the data processor.
3. A customer in the meaning of the privacy policy is anyone who purchases goods or services from the data processor's website.
4. The data processor follows the principles of data processing set out in legal acts, among other things, the data processor processes personal data lawfully, fairly and securely. The data processor is able to confirm that personal data has been processed in accordance with legal acts.

2. Collection, Processing and Storage of Personal Data

1. Personal data collected, processed and stored by the data processor is collected electronically, mainly through the website and email.
2. By sharing their personal data, the data subject gives the data processor the right to collect, organize, use and manage personal data for the purpose defined in the privacy policy, which the data subject shares directly or indirectly with the data processor when purchasing services on the website.
3. The data subject is responsible for ensuring that the data they provide is accurate, correct and complete. Knowingly providing false information is considered a violation of the privacy policy. The data subject is obliged to immediately inform the data processor of changes to the submitted data.
4. The data processor is not responsible for damage caused to the data subject or third parties by the data subject providing false information.

3. Processing of Customer Personal Data

The data processor may process the following personal data of the data subject:

• First and last name
• Date of birth
• Phone number
• Email address
• Payment card details

In addition to the above, the data processor has the right to collect data about the customer that is available in public registers.

The legal basis for processing personal data is Article 6(1) points a), b), c) and f) of the General Data Protection Regulation: a) the data subject has given consent to the processing of their personal data for one or more specific purposes; b) processing of personal data is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; c) processing of personal data is necessary for compliance with a legal obligation to which the controller is subject; f) processing of personal data is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

Processing of personal data according to the purpose of processing:

• Processing for the protection of property and security – personal data is stored for the periods specified by law
• Processing to ensure the functioning of e-services – personal data is stored for a maximum of 7 years
• Processing for customer management purposes – personal data is stored for a maximum of 7 years
• Processing purpose – financial activities, accounting – personal data is stored for the periods specified by law
• Processing for marketing purposes – personal data is stored for a maximum of 7 years

The data processor has the right to share customers' personal data with third parties, such as authorized data processors, accountants, transport and courier companies, companies providing transfer services. The data processor transfers the personal data necessary for making payments to the authorized processor Maksekeskus AS.

When processing and storing the data subject's personal data, the data processor applies organizational and technical measures that ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure and any other unlawful processing.

The data processor stores data subjects' data depending on the purpose of processing, but not longer than seven (7) years.

4. Data Subject Rights

1. The data subject has the right to access and review their personal data.
2. The data subject has the right to receive information about the processing of their personal data.
3. The data subject has the right to supplement or correct inaccurate data.
4. If the data processor processes the data subject's personal data on the basis of the data subject's consent, the data subject has the right to withdraw consent at any time.
5. The data subject has the right to contact the karting center's customer support at dpo@motorcity.ee.
6. The data subject has the opportunity to file a complaint with the Data Protection Inspectorate to protect their rights.

5. Final Provisions

1. These data protection terms have been prepared in accordance with Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the Personal Data Protection Act of the Republic of Estonia and the legal acts of the Republic of Estonia and the European Union.
2. The data processor has the right to partially or completely change the data protection terms, informing data subjects of the changes through the website (www.motorcity.ee).

Basic Concepts and General Provisions

These terms constitute a legal agreement between you and Motorcity OÜ for the purchase of services. By using our services, you agree to enter into a legal agreement, comply with it, and confirm that you have read the privacy policy. If you do not agree with these purchase terms and/or privacy policy, you cannot use the services.

System

e-shop with installed tools located at www.motorcity.ee.

Service Provider

Motorcity OÜ registered in the Commercial Register at Laeva 1, Tallinn 10111, reg. code 16051241, VAT number EE102382930.

Client

a natural or legal person who, as an end user, purchases a Gift Card or orders services in the System or uses other services offered in the System, regardless of whether they order the Gift Card and use it independently or the rights to the Gift Card (e.g., as a gift) have been received from the person who purchased the Gift Card.

Gift Card

a gift card with a gift card code, upon activation of which the Client has the right to request one of the services specified on the gift card or offered in the System according to the terms specified on the gift card. The activated Gift Card code is the only document confirming the order and payment of the service selected according to the terms specified on the Gift Card.

Gift Card Code

the code marked on the Gift Card gives the right and opportunity to make a Booking.

Buyer

a private person who purchases a Gift Card through the System by submitting an Order and paying for it.

Privacy Policy

defines the purposes, sources, legal bases of personal data collected and processed about you, determines the rights of data subjects and the procedure for their implementation, and also provides other information required by applicable law related to the protection of your personal data.

Service

service offered by the Service Provider.

Account

personal account created in the System, protected by the Client's name and password.

Booking

selection and booking of a Service using the System's booking tool or in another manner specified on the Gift Card, using the Gift Card code(s).

Validity of Sales Agreement, Product and Price Information

1. The sales terms apply when purchasing goods from the Webshop.
2. The prices of services sold in the Webshop are marked next to the products. All prices of services sold in the webshop are in euros.
3. Information about the service is provided in the Webshop directly next to the service.

Order Processing

To purchase a service, add the desired products to the shopping cart. To complete the order, fill in the required data fields. Then the amount to be paid will be displayed on the screen, which can be paid securely through the following Maksekeskus AS payment methods:

• Estonian bank payments
• Finnish bank payments
• Latvian bank payments
• Lithuanian bank payments
• Visa/Mastercard card payments
• Apple Pay and Google Pay

When paying with a bank link, be sure to press the button 'Return to merchant' on the bank's page.

Right of Withdrawal

1. The purchased karting service or gift card is valid for an unlimited period.
2. The service or gift card cannot be returned or exchanged for cash.
3. The service can be gifted or transferred to another person.
4. The service is considered used from the moment the ride has actually taken place or the gift card has been registered for use.

Direct Marketing and Personal Data Processing

1. The Webshop uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Webshop forwards personal data to companies providing transport services in order to deliver the goods.
2. The Webshop sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to do so by entering an email address on the website and indicating their wish to receive direct mail notifications.
3. The buyer can at any time opt out of offers and newsletters sent to email by notifying us by email or by following the instructions in the email containing the offers.

Dispute Resolution

1. If the buyer has complaints about the Webshop, they should be sent to the email address info@motorcity.ee or call 5504555.
2. If the buyer and the Webshop cannot resolve the dispute by agreement, the buyer has the option to turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Webshop. The review of the buyer's complaint in the committee is free of charge.
3. The buyer can turn to the European Union consumer dispute resolution platform.
